Whiplash Claims Average Payout

At The Injury Lawyers, we pride ourselves for being highly experienced in dealing with whiplash claims.  It is this experience that allows us to say to our clients that we strive to get them the best possible amount of compensation for their whiplash claim. But how much compensation are you likely to receive for a successful whiplash claim?

Average Payouts

When considering average payouts for a successful whiplash claim, the most relevant item to discuss is that of the Judicial Studies Board Guidelines. These guidelines band whiplash injuries for the purposes of valuations. These bands include Minor, Moderate and Severe bands for neck injuries.

Minor whiplash injury amounts:

  • A full recovery after a few weeks to a year – the payouts range between  £875 to £2,850
  • A full recovery within 2 years – payouts range between £2,850 to £5,150
  • The average payout for a minor injury is around £2,850.

Moderate whiplash injury amounts:

  • Moderate whiplash injuries range from £5,150 to £16,400

Severe whiplash injury amounts:

  • Severe injuries can range up to £97,000.

For severe injuries, it is especially essential that you get a specialist personal injury lawyer on your side, with years of experience in dealing with serious injury cases, and complex claiming.

How can you ensure to maximise your compensation?

In order to maximise your compensation, there are some simple steps you can take:

Step 1: Choose an independent specialist personal injury lawyer who is highly experienced in the area of personal injury and whiplash. They will then use all their skill and expertise in order to fight tooth and nail for your claim.

Step 2: It is advisable to avoid referral agencies who act as middlemen to sell your claim on to a law firm, for fees as much as £800. If your law firm has paid this much for your claim, less profit can be made, so some law firms may balance this out by working less on your claim, which in turn gives you lower service standards, and may not maximise your compensation amount. They may even take a percentage or a deduction from your claim, or simply charge you.

Step 3: For the same reasons as above, it is also advisable to avoid Legal Expense Insurance, as the insurer does the same thing and acts as a middleman by selling on your claim to a law firm. This law firm may not be the one which will give you the best service, and have the most experience, but the one which pays the most for your claim.
