Types of Personal Injury Claim

All personal injury claims have two things in common. Firstly, someone has suffered either a physical or mental injury; and secondly, the injury was someone else’s fault.

Under the broad heading of personal injuries, there are many different particular types of personal injury claims.

The most common claims are for injuries caused by road traffic accidents.  The victims of road accidents may suffer injuries ranging from mild whiplash through to severe life threatening injuries, and all too commonly, fatalities. People injured by another road user will claim compensation against the other person’s insurance company, or the Motor Insurance Bureau that can step in to provide compensation to the victims of uninsured or untraced drivers.

Employers liability claims are another very common type of personal injury claim. These happen when an employee is injured whilst they are working because their employer has failed to take proper precautions to protect their employees’ safety. These claims can include relatively minor injuries caused by work accidents such as tripping over obstacles in corridors, through to serious or fatal accidents caused by heavy industrial machinery.

Over recent years there has been an increase in the number of claims for occupational and industrial diseases that have been caused through a person’s employment. These can take years to develop and the symptoms may only occur years after the employee has left their job. There are many different types of industrial disease, including Vibration White Finger, Repetitive Strain Injuries, Carpal Tunnel Syndrome, Noise Induced Hearing Loss (Deafness), and skin conditions such as Eczema. Some industrial diseases can be life threatening, such as asbestosis related illnesses.

Another major type of personal injury claim comes under the heading of public liability claims. This covers accidents that happen on property open to the public, including public roads, or pavements or, in a building – such as a shop, cinema, or pub.  If the owner of the property fails to make sure that the property is safe for public use, and this causes a member of the public to have an accident, that person can claim compensation for their injury against the owners insurance.

Claims for injuries caused by defective products are aptly named product liability claims. These can include injuries caused by any type of product sold in this country, including electrical items, food, furniture, toys, clothes, tools and many more.  The injury must have been caused by a defect in the product that made it dangerous, or because the product was not made to a sufficiently high level of safety in the first place.
