The problem is that many people who instruct a personal injury lawyer to make their claim have probably never made a claim in the past (unless you’re a little unlucky); so many people don’t quite know what to expect, or what they are entitled to. Many people will make their judgements based on what friends and family say. So, how do you know what to do when you are entering in to a process that you have never been through before?
Well, here is a little hint: check the Client Testimonials on the website of the law firm you are looking to instruct!
We are very proud and humbled to hear what our clients think about us when we have concluded their claim. We always ask for their honest feedback as to where we excelled in our service, and even where we could improve (hey – no one’s perfect!). So it’s nice to know when our clients compliment us on the things we specifically try and do to make our service better than others.
For example, we always inform our clients right from the start that we operate a Genuine No Win No Fee – by genuine (a term we have coined in a way to set it aside from others), we mean that, unlike most other law firms that operate using the standard No Win, No Fee agreement, we genuinely do not charge our clients because of the way we write our agreement.
Under the standard wording, most lawyers will only “seek to recover” or “try and recover” or “endeavour to recover” your legal fees from your opponent; and leave it at that. This means that, taking the terms above literally, their duty is only to make an attempt at recovering legal fees from the other side. If they fail, you are liable. Some are more explicit, and will say that you are directly responsible for anything that isn’t recovered. So… what’s the problem?
Well the fact of the matter is: they can charge you. If they fail to get all of their fees recovered, you are responsible for paying the remainder. Don’t get me wrong; I’m not saying there is anything wrong with the standard wording, and I’m not saying all companies will use this power. But they still could, if they wanted to, charge you; and some will. This means that, technically, in writing, you are not guaranteed 100% compensation as there are potential ways you can be charged.
There is another way you know –
We decided to address this use by adding in an extra line to our agreement saying that “If, for any reason, we are unable to recover our fees from your opponent, we shall NOT look to recover the fees from you.” One simple paragraph right there actually guarantees you that genuinely, in writing, you will receive 100% compensation. Many of our clients love this little safety net.
