Before April 2010, getting hold of the compensation you deserved for your whiplash injury could have taken longer than you wanted – but now, thanks to a new system we have in place, you can get compensation in just a few short weeks or months. Let me explain how…
If you had been suffering from whiplash from a car crash a couple of years ago, getting compensation could have taken a year or more. This was because the insurers for the person who caused your whiplash were allowed a period of almost four months to simply admit that the accident was their fault (this was a stator investigation period length they had), and then after this it could take several more months to get medical evidence and settle your claim.
This was far too long! How could something that was so obviously the other person’s fault take so long to admit liability for? Well, the good news is that some people began to realise this was unacceptable and created a new system which only allows the Defendant around three weeks to admit or deny liability. This is of course much better!
What you have to do under the new system is submit a Claim Notification Form (CNF) to the Defendant’s insurer via an online portal. The CNF is easy to complete and contains useful information like all driver’s details, the date of the accident, what happened in the accident, and what injuries you have. Don’t worry if you are not sure how to do this, because a quality injury lawyer will go through this with you and make sure everything is done on your behalf. Once the CNF is ready, the Defendant’s insurer has just one day to acknowledge it and then around three weeks to admit or deny liability.
After the Defendant has admitted liability, it is just a matter of getting a legal medical report prepared and settling your claim. This should only take a month or two, and you can rest assured that an injury lawyer will set up an appointment a medical appointment at a time and place which is convenient for you – and give you fantastic advice on any offers you may get for your whiplash injury.
