An online portal is now used for the majority of road traffic accident claims. One main aim of the portal is to speed up the claims process. The online portal is used for low value personal injury claims, that is, where the value of the case is expected to be between £1,000 and £10,000.
The portal is basically an online system which allows Solicitors to correspond with insurers and send documentation electronically. At the outset of the claim the Claimant’s Solicitor will obtain details of the accident from the Claimant (such as the accident date, circumstances, weather conditions, the name and address of the Defendant etc). The Claimant’s Solicitor can then submit a Clam Notification Form (CNF) to the Defendant’s insurers. If the Defendant’s insurers are unknown the Claimant’s Solicitor can usually obtain the details.
The CNF provides all the necessary information to enable the Defendant’s insurer to investigate liability. The portal imposes time limits upon the Defendant’s insurers, if they fail to respond within 15 business days the claim can be “pulled” or removed from the portal. The strict time limits allow Solicitors to progress the claim as quickly as possible.
If liability is admitted within the 15 business days then the Claimant’s Solicitors would proceed to obtain medical evidence which can be used to value the claim and negotiate settlement.
If liability is denied or the Defendant’s insurer fails to respond within 15 business days then the claim can be removed from the portal and progressed in the “normal” way (i.e. progressed as it would have been before the portal was introduced). If liability was denied the Claimant’s Solicitor would review the case and correspond with the Claimant to decide or evaluate the prospects of success. If the Claimant’s Solicitor decides to continue with the claim, medical evidence would be obtained and if settlement cannot be agreed, the only option would be to issue Court Proceedings.
Road traffic accident claims can be settled within 4 to 6 months but it is important to note that in law every case is different and at the outset of the claim a Solicitor can never guarantee how long a case will take.
