Well, as always, it’s all circumstantial – so you will probably need to give us a call and we will be able to better advise as to whether it’s something you may be eligible to make a personal injury claim for. With most law firms now taking 25% of people’s compensation and charging you for insurance, you will probably find our better deal more appealing. But until you call us, here is some insight in to scenarios where you may have a claim for compensation:
Right of Way
If you are already on the roundabout and someone pulls out in front of you, it’s highly likely you will have a successful claim if you are injured. It is the right of way of the person already established on the roundabout, so anyone pulling on to it needs to give way. For mini roundabouts, you give way to your right – but take care if you end up in a standoff between three vehicles all giving way to each other!
But in general, if you’re already on the roundabout, you shouldn’t be at fault.
Rear End Collisions
Usually on the foot of a roundabout or on a larger one when traffic suddenly slows – but the general principle anyway is that if someone goes in to the back of you, it’s their fault. So if you are the victim of a rear end collision, you almost certainly should have a successful claim for personal injury compensation.
Changing Lanes
This is where it can get tricky – in principle, if someone changes lane in to yours, or if someone is in the wrong lane and cuts you up, they are at fault. But unfortunately it isn’t always easy to prove who is actually to blame unless there were witnesses, or CCTV footage covering the area. Society isn’t always as honest as it should be, and we’re no stranger to hearing Defendants lie through their teeth to try and avoid paying out. Although the insurers foot the bill, premiums are likely to go up!
You should take photos of the vehicles after the incident if it is safe to do so, and take photos of any areas of damage that may prove who is at fault. Hopefully the other driver will be honest and accept liability, but we don’t always live in an ideal world! Call the police if you are unsure, and take down the names and contact details of any witnesses. If you’re reading this after already being in an accident, I hope you did some of the above.
Next, whether the other side is accepting liability or not, you need a lawyer to deal with the personal injury claim so give us a call 0800 634 7575 and we will get a case started for you on the very first phone call if you are happy for us to do so!
