Who is at fault in a Roundabout Accident

Right of Way

If you are already on the roundabout and someone pulls out in front of you, it’s highly likely you will have a successful claim if you are injured. It is the right of way of the person already established on the roundabout, so anyone pulling on to it needs to give way. For mini roundabouts, you give way to your right – but take care if you end up in a standoff between three vehicles all giving way to each other!

But in general, if you’re already on the roundabout, you shouldn’t be at fault.

Rear End Collisions

Usually on the foot of a roundabout or on a larger one when traffic suddenly slows – but the general principle anyway is that if someone goes in to the back of you, it’s their fault. So if you are the victim of a rear end collision, you almost certainly should have a successful claim for personal injury compensation.

Changing Lanes

This is where it can get tricky – in principle, if someone changes lane in to yours, or if someone is in the wrong lane and cuts you up, they are at fault. But unfortunately it isn’t always easy to prove who is actually to blame unless there were witnesses, or CCTV footage covering the area. Society isn’t always as honest as it should be, and we’re no stranger to hearing Defendants lie through their teeth to try and avoid paying out. Although the insurers foot the bill, premiums are likely to go up!

You should take photos of the vehicles after the incident if it is safe to do so, and take photos of any areas of damage that may prove who is at fault. Hopefully the other driver will be honest and accept liability, but we don’t always live in an ideal world!
