Surgeons must give the patient reasonable information about the risks to enable the patient to give valid consent to surgery. Therefore, if you do not feel you have been given enough information about potential risks and side effects, you may be able to claim on this basis. Some of the most common injuries/claims in this area stem from the following:
- Asymmetry – negligent cutting can create a mess!
- Swelling in the legs
- Nerve Damage
- Infection (although this can always be considered an inherent risk so may be difficult!)
- Skin or Fat Necrosis (this is where the cells die due to failure of blood supply)
- Blood clots
As referred to above, all surgery comes with inherent risks and therefore to claim for compensation we have to be able to show that it is not just a risk that has happened but negligence; and that if it had not been for this negligence the risk would never have arisen.
For example: if the Surgeon cuts a nerve by failing to concentrate resulting in numbness, this could be negligent. But if it is an inherent risk that it may occur and you are given proper notice that it might be an unavoidable inherent risk, the surgeon could defend the claim on that basis.
These types of cases are notoriously difficult to prove and therefore can take a while to investigate and settle as there is a lot of work that needs to be done! Therefore, it is important you get the best representation to ensure your claim is dealt with professionally and efficiently.
