Injury caused by waiter / waitress in restaurant or cafe? Advice from The Injury Lawyers

No one expects to be injured through no fault of their own – and it can be even more annoying when you’re injured at a place you’re meant to be enjoying yourself. To be fair to waiting staff, their jobs can be very stressful and an absolute nightmare. I know – I’ve worked in them myself before.

But ultimately if you are injured by a member of the waiting team, you may be entitled to make a claim for personal injury compensation from the restaurant. Read on for more information.

It Happens…

It can happen – some common scenarios are:

  • Having hot food or liquid spilled on you causing injuries
  • Having a plate or other heavy item dropped on you causing an injury
  • Being hit by a member of the waiting staff rushing around (hit as in walking in to you – not assaulted!)
  • Being handed a hot plate (or not being warned about something that’s very hot!)

So if you are injured in an accident that was entirely preventable, you may be able to make a claim from the owners insurance. Normally you wouldn’t sue the actual person themselves – their actions are the responsibility of the employer, which will normally be the restaurant, cafe, or other proprietor of the place.

Injuries can of course range from minor to severe burns, which could leave scarring, or general soft tissue injuries – but either way, you don’t have to be seriously injured in order to make a claim. As long as there is an injury, we should be able to assist in making a claim.
