How No Win, No Fee Works
No Win, No Fee means that you will not be charged if the case is unsuccessful. Obviously there are terms and conditions that apply, and I cannot speak for all lawyers out there who may not have a good agreement like we do, but the principle is that the agreement does exactly what it says – you don’t win, you pay no fees.
There are several reasons as to why we do this – primarily because we will only take on a claim if we think we have a shot of winning it, so it’s a business decision to take the risk of the case on. In addition, you probably wouldn’t want to make a claim if there was a risk of paying something.
With our agreement, there are no catches or hidden stings – if we don’t win, we don’t get paid by anyone! So yes, we do lose money; but as I said earlier, it a business decision for us to take the risk of it on.
How a claim works
In most cases we simply submit a Claim Notification Form to the supermarket directly, or to their insurers, and they then have 40 working days to accept liability. We can set up a medical appointment straight away as well, and the idea is that if they admit liability, we should be ready to negotiate offers immediately.
So it isn’t too costly for us to investigate the claim and write off fees if we cannot win the case.
100% compensation for supermarket claims
Unlike other law firms, we can still give you all 100% of your compensation. The law changed in April 2013 meaning lawyers cannot recover all of their fees from the other side anymore. But even though we’re getting less fees than we used to, we still let our clients keep all of their payout as we take the hit ourselves.
