So it’s a business decision to take the risk of the case on, and it’s totally down to us to accept the risk of not getting paid.
The Law for slip and Trip claims
I’ll split this in to two categories – one for work claims, and one for public claims.
Work Claims
The law that commonly applies is The Workplace (Health, Safety and Welfare) Regulations. The regulation that can be most commonly cited is Regulation 12 (3) that states:
This means an employer has a specific duty to make sure that floors are not going to be a slip or trip hazard for employees, and this can be enforced with things like training and safety procedures, and regular inspection and maintenance systems.
Public Claims
Perhaps if you’re out and about in a supermarket, shop, restaurant, or similar, the duty under The Occupiers Liability Act is to enforce a system of inspection and maintenance to take all reasonable steps to ensure the safety or visitors to the premises. Training for employees of the premises should also be in place as well.
In either circumstance, if whoever is in control of the premises has not taken reasonable steps to prevent accidents, you could have a good slip or trip claim to make.
