As our name suggests, as The Injury Lawyers, we exclusively help and represent victims for injury claims. Our level of expertise and our years of service which has been dedicated to victims of negligence has meant that we have recovered millions of pounds in compensation for victims of injury just like you.
Noise Induced Hearing Loss (or NIHL for short) claims resulting in tinnitus and hearing loss is amongst our specialities.
It can be difficult for a victim to know they have suffered right away as the symptoms will likely appear later on in life. Despite the fact that you may have been exposed to dangerous levels of noise in the workplace several years ago – you are not necessarily barred from claiming for starting the case several years on from the events.
You may have heard of the expression “have you had an accident in the last three years?” – well this stems from the general limitation to claim period here in England and Wales which is commonly three years from the date of an accident or incident. If you try to bring a claim outside of this period you may be unable to do so.
But – in Noise Induced Hearing Loss cases the limitation period is all about when you were first made aware that you have sustained an injury as a result of negligence. If you have recently been to your doctors and you have been diagnosed with Noise Induced Hearing Loss or tinnitus as a result of high exposure levels at work, then the date of diagnosis can be the trigger of the limitation period beginning.
It is assessed on a case by case basis and there are other factors to consider so do not leave this to chance – as soon as you become aware of a potential problem, contact us immediately.
What if my company has shut down?
Even if the company you worked for that caused the exposure has long since gone, you can still claim. We have lists of insurers for the major companies who typically exposed workers to high levels of noise, and if your firm is not on our lists, we can still investigate the insurers identity anyway.
What if I think more than one company exposed me to noise?
This doesn’t stop you making a claim for hearing loss – we can sort out all of the splits and disputes between the insurers. Our aim is to make sure you are compensated as quickly as possible.
