Your rights explained
The law we typically use here is Supply of Goods and Services Act, and the key elements of this legislation mean that products should be:
- Of satisfactory quality
- Fit for purpose
- As descried or expected
So in essence if the product is defective in any way and this has caused you harm then these regulations are very useful indeed. They often imply an almost strict liability on the supplier of the product to you which means it’s very difficult for them to defend a case. If a product is defective, then it is defective.
The product must be as described as well so if it is not what you expected and this has resulted in harm to you then you have rights to claim in the same way.
Who do I claim from for product recalls?
This is the key element – with most products being manufactured abroad these days it isn’t very easy to pursue a foreign manufacturer. But this is where the Supply of Goods and Services Act reigns supreme in terms of useful legislation!
You may have spotted that a key word in the law here is the “supply” of goods and services. That means that the supplier of a product can be jointly liable if it is either defective, not fit for purpose, or not as described. Simply put, you actually just claim from the supplier of the product in the vast majority of circumstances.
So if it’s a leading supermarket brand like Tesco or Asda you bought the product from then they are liable – it’s as simple as that.
