Compensation for work injuries from forklift truck accidents
You could be entitled to claim compensation for work injuries from forklift truck accidents where you were not at fault for the incident in question. If you were not at fault for the accident, and we can show that there has been a breach of health and safety regulations, you could be eligible to pursue a case. We may be able to represent you on a No Win, No Fee basis.
A lot of work injuries from forklift truck accidents arise due to the negligence of a colleague, which is still something that you could potentially claim for. Any negligence of a colleague can mean that your employer can be found to be “vicariously liable”, which means that they must shoulder the responsibility for the negligence. This can allow you to pursue a claim for compensation against your employer directly, and use their insurance to claim damages from.

Recent HSE prosecution
Sadly, some work injuries from forklift truck accidents are so severe that the accident victim loses their life. In a recent publication from the Health and Safety Executive, there was a tragic story of an accident of this nature in Salford in 2020 when an employee was struck by a forklift truck. Unfortunately, the victim reportedly suffered serious head injuries and died at hospital having never regained consciousness.
The HSE, in these kinds of cases, must pursue prosecutions. In this case, at a Manchester Magistrates Court hearing, the company involved pleaded guilty to breaching health and safety regulations. The company in question was subsequently ordered to pay a fine of £800,000 and pay costs of over £5,500 pounds.
