Can I claim for broken glass injury from a nightclub floor?

Glass on a nightclub floor is a common occurrence and an obviously dangerous hazard. It’s the reason that many places now have plastic cups and plastic bottles because of the absolute nightmare that broken glass on the floor can be.

So if you are injured by glass being on the nightclub floor, can you make a claim for personal injury compensation? Read on for more advice…

A nightclub will normally have to abide by the Occupiers Liability Act which means there is a duty on them to take all reasonable steps to prevent people from being injured on their premises. So we first need to look at what is reasonable for us to be able to determine if you have a successful case or not.

What is seen as reasonable to avoid floor hazards are often things like:

  • Systems of inspection and maintenance
  • Cleaning polices and regimes
  • Staff training to look out for and spot hazards
  • Reacting to notified hazards in a quick enough time period

Usually glass being on a nightclub floor is caused by a punter dropping something. For this reason you cannot automatically hold the nightclub at fault because controlling such events is nigh impossible. But they are at fault if they fail to have and to uphold reasonable step like those mentioned above.

So if the glass being on the nightclub floor has been left there for too long, or won’t get picked up on because there are no systems of inspection, cleaning, or other policies for staff, you can have a successful claim.

It can actually be very common for the nightclub to be at fault because when they get busy the staff are often rushed and health and safety is either missed or ignored. So if you have been injured because of glass being on the nightclub floor then we may be able to investigate the case for you on a no win, no fee basis.
