How Much Can I Claim for a Whiplash Injury?

whiplash injuryWhiplash is usually a lot more complicated than most people think. If you have never suffered from it, you probably don’t have much regard for a person making a whiplash claim. But if you have or are suffering from it, you’ll know it is a real injury and it can be an absolute pain. I’ve had it myself.

So if you want to make a whiplash personal injury compensation claim, how much should you receive? Is it worth making a whiplash claim?

Most people fall within the minor whiplash category. I’m talking about the legal definition of minor, not your doctors. So if your doc has told you that you have severe whiplash, that doesn’t mean we will define it as the same.

If you recover in less than 2 years, most people will fall within the minor whiplash category. The brackets that are used to value these claims generally go between around £1,000 to £5,000. Where you fit on that scale is entirely dependent on the following things:

  • The level of pain, suffering, and loss of amenity caused.
  • The length of the suffering.
  • The affects it has had on you and your individual lifestyle.
  • Any losses like lost earnings, treatment expenses, or care claims.

If you suffer for just a few weeks you can probably expect a payment of around £1,000 or so.

But it can also depend on the type of lawyer you have chosen to deal with your claim. I recently settled my whiplash claim for £6,500 and I put a lot of that down to the hard work of The Injury Lawyers fighting for my case. Too many lazy lawyers nowadays will tell you to accept any old offer as long as it sounds like it is near enough matching the brackets. But we fight to get you more.
