Do I have a Daybrook dental claim?
If you have ever received treatment from Mr Desmond D'Mello at the Daybrook Dental Practice in Arnold, Nottinghamshire, then you may be entitled to claim for compensation what has happened.
There are concerns about the records kept by Mr D'Mello which may result in difficulties in tracing patient information - so if you know that you have been treated by him in the past, we urge you to come forward.
One important thing to know is that you do not have to have suffered an infection whatsoever to be eligible to make a claim.
Am I entitled to compensation?
If any of the following apply to you then you may be eligible to claim compensation:
- The news has caused distress and / or upset at the risk of being exposed to serious infections such as Hepatitis or HIV - often referred to as a "worried-well" claim
- You have undergone testing for infections as a result of being a former patient of Mr D'Mello
- You have contracted an infection as a result of Mr D'Mello's lack of adherence to infection control procedures
- You have suffered a psychiatric illness as a result of the impact of the news that you may have been exposed to a serious infection
Will I win my claim?
For clinical negligence cases it is always difficult to know whether you have a claim or not. On top of that, there has never been a scandal of this nature and scale in the UK ever - so there are new areas of law to investigate here.
Our team have successfully won compensation for a large majority of the PIP Implant scandal victims and we're can fund the whole of a claim for the Daybrook Dental scandal on a no win, no fee basis. We have also represented victims for similar cases in the past where the victim may have been exposed to an infection. A similar principle applies here in that you claim for the potential of being infected and having to wait a long time with the worry of infection on your mind.
It's good to know that we work on a no win, no fee basis, and it's good for you to know that we only ever fund the whole of the claim if we think there is a good enough chance of winning. If you fall within our criteria where we think we may be able to help you then we can look at offering a no win, no fee agreement.
But given the huge volume of people affected, there is every chance that there will be a fight on our hands - but we're prepared for battle to make sure we fight tooth and nail for your rights as a victim of negligence at the hands of Mr D'Mello who failed to follow even the most basic of infection control protocols and procedures.
We are aware that Mr D'Mello had initially agreed to cooperate with the investigation but it has since transpired that he has now instructed lawyers.
What is the cost to claim?
We work on a genuine no win, no fee basis so you do not need to pay any upfront costs to us and we can write off our legal fees if we don't win the case. Many law firms out there do have upfront costs and fixed charges that need to be paid at the start or during the claim - we do not!
So as long as we are confident that we can win the claim then we can put in writing to you that we will not charge you if the case doesn't succeed. It's important for us to be able to assess your claim right from the start, and we can normally do this in one phone call with you and tell you in minutes if we think you have a claim.
If the claim wins, you need to know that important changes in government legislation have affected the way in which legal fees are recovered from the opponent. What we offer you are guarantees to make sure you are never stung with any hidden charges or costs - and we're a real actual law firm, so there are no middlemen involved in the process.
Coming directly to us as a specialist law firm gives you access to the best legal advice and representation without the need for middlemen to complicate the process - and we're midlands based too!
