The Scottish Law Commission (SLC) are considering reforms to extend the time limit on personal injury claims from three to five years. The proposal is designed to help cases involving occupational diseases where it can be extremely time-consuming for the claimant and their representation in obtaining evidence.
In contrast the government in England and Wales are looking to push new legislation will will in effect reduce the time on certain personal injury claims.
Its not surprising that a few insurers North of the Border have raised an objectional eyebrow to the SLC proposals. Simon Denyer, of DWS, says of the SLC proposals surprising because “they are out of kilter with other developments which will have the effect of speeding up cases”.
