Road traffic accidents – there pretty straightforward when it comes to claiming compensation for them. In fact they are the most clear-cut claims for injury there can be. The reason is that in a road traffic accident the blame is usually quite easy to establish. And there are many ways a road user can be liable for compensation through negligent driving. One of the more regular driving offences that can lead to accidents is speeding :
Speed limits are there for a very good reason – to save lives! Speed limits are set for roads according to the type of road in question. For example most city roads and populated areas (I’m sure you already know!) have 30mph speed limits given that they are densely populated with other drivers and pedestrians. A motorway of course is set at 70mph as the intended purpose is just for motor vehicle travel between the junctions – there aren’t any pedestrians or turns and cross roads to navigate. So it’s safe to travel at a higher speed.
So breaking the speed limit puts other road users and pedestrians at risk (again, a rather obvious point but let’s face it, breaking the speed limit DOES cause accidents). And if a driver speeds and there speeding causes an accident, then they are liable for any compensation to the other drivers involved! So say if a car is speeding and fails to stop in time and bumps you up the backside, then they are liable for any injuries you may sustain!
You break the law – then you are negligent for any accidents you cause! Its as simple as that really!
And on the subject of speeding, does anyone know who Piers Morgan is? Britain’s Got Talent Judge, TV presenter, and general celebrity personality? According to sources from The Independent (source), the TV talent show panelist has just been found guilty of speeding, incurring a £666 fine, £58 in costs, and 3 points on his driver’s license.
The 45 year old was caught on a speed camera doing more than 50mph in a 30mph zone in Brighton last November, according to the report. He has been convicted at Brighton Magistrates Court after pleading guilty to the charges. And if he had have caused an accident through his reckless driving, he would have been liable for any suffering caused to the victims involved!
So if you have been involved in a road traffic accident that wasn’t your fault, its more than likely you have a claim for compensation! Most cases are straightforward in nature, but its best to seek advice and representation from an expert independent personal injury lawyer when it comes to claiming. Only will an expert make the best out of your claim by making sure you get the maximum you are entitled to recover under the law, and receive the payout in the quickest possible time.
