Claiming for Attacks

If you have been attacked by another person in an unprovoked act of violence, you may have a potential claim for compensation.

Depending on the circumstances of the incident it may be worthwhile you looking into the matter of claiming for compensation. If you have been attacked as an obvious attempt of violence, such as being assaulted on a night out, or if someone has thrown an object at you and the incident was unprovoked, you should consider placing a claim.

If you do decide to place a claim, your claim will go through the Criminal Injuries Compensation Authority (CICA); a government body that pays out for injuries sustained as a result of an act of violence from another person.

You can go through the CICA solely by yourself, however the CICA are well known for under settling compensation claims and taking a significant amount of time with it, so it’s always advisable to obtain representation from an independent firm of personal injury solicitors. You will be charged a small percentage of your claim from the solicitors as unfortunately the solicitors legal fees cannot be recovered from the CICA. However, it is usually very worthwhile to obtain legal help as your end settlement sum can be substantially more than what is claimed if you were to go through the CICA on your own.

Before deciding what is best for you, you need to record the circumstances of the accident – such as the time, date, location etc. if any witnesses were present it will be helpful to take their names and contact details. You should report the incident to the police every single time, and seek medical attention within 48 hours of the incident.
