Claiming Compensation Against an Employer

Accidents at work can be extremely serious- especially if you work with dangerous equipment. Injuries can be extremely debilitating and can even affect future employment opportunities. Although many people know they are entitled to compensation and may be in desperate need of it to cover loss of earnings, medical expenses and other such losses, many are hesitant to claim against their employer.

However, employers know that, unfortunately, accidents are a part of life and although all steps can be taken to avoid them, it is sometimes unrealistic to think that one is never going to happen. For this reason, employers are obliged to have Employer’s Liability Insurance under The Employers’ Liability (Compulsory Insurance) Act 1969 and they can be fined if they are not found to have a valid policy in place – (this is different to Public Liability Insurance which is sometimes optional).

This ensures that, if an employee is injured in the workplace, the employer will be able to meet the claim for compensation should they be eligible to make one. Usually, this means that the claim is between us and their insurance – for example the majority of the time the employer will receive the letter of claim (this is the first letter that is sent from us detailing the claim) and pass it straight across to the insurance and then it is them that we will correspond with- not your actual employer.

Also, the fantastic thing about UK law is that this insurance also covers legal fees and therefore we can offer our Genuine No Win No Fee Agreement to anybody wishing to pursue a claim against their employer. This means you will receive 100% of your compensation payout. Who knew insurance could be so helpful?!

Also, you are significantly protected by the law – you cannot be sacked for pursuing a claim. Large companies are pretty much claimed from all the time and therefore may even encourage you to pursue a claim – after all if they have insurance, so why not use it?!

People often presume that claiming against their employer is a resentful process but it is actually rather amicable. Employers should know the law and they know that accidents will inevitably happen so it does not come out of the blue to them when someone pursues a claim. It is a just part of life to claim from your employer if you have been injured at work so please DO NOT WORRY.

Another worry that I often speak to people about is that they are nervous about continuing work and not knowing when their employer will find out they are claiming or are left in the dark. Here at The Injury Lawyers, we do things as fast as you want them to be. You can call us, confirm and pass all the details across and the claim form can be submitted to the other side basically straight away!

So if you would like to discuss a potential claim against your employer call us today for friendly no obligation advice.
