Hit by a Car on my Bike – Can I Claim?

bicycle accident injury claimsMost people nowadays try and do their little bit to be as green as possible. In our office we have a policy of naming and shaming those who leave their monitors on at the end of the working day – it’s something we check each night before we close up. With our continued efforts to be greener, and given the ridiculous price of fuel, many are taking to the streets on bikes as a cheaper and more environmentally friendly mode of transport. And I guess it’s healthier too.

But in the stressful streets of the UK as one of the hardest working countries in Europe, our roads are bursting at the seams with traffic during the rush hours as busy commuters rush to get to work on time. Many drivers don’t keep a proper look out for cyclists as it is – but at 8am in the morning when we’re tired and grumpy, we’re even less alert than we should be and accidents can easily happen.

That’s why we have a pledge to fight as hard as possible to make sure that any innocent cyclist who is hit by a negligent driver receives the compensation they deserve. We often find that injuries can be fairly serious given that you don’t have the protection a car offers when you are riding a bicycle.  That’s why our bespoke way of working is designed to not only compensate you for your injuries, but to get you the best private medical care we possibly can.

Here’s How We Work

Liability

We need to submit your Claim Notification Form to the insurer to start the case. As long as you have a registration number for the driver at fault, we can set your case up and submit the claim form on the same day you speak with us. The insurer then has 15 business days to accept liability. If we don’t get a response, we will be as ruthless as we need to be to get them to accept full liability for your accident. On many occasions drivers will try and give an alternate version of events – so we’re here to fight for your rights!

If you don’t have the reg number, it helps if you can contact the police and obtain it – if they have it. If they won’t give it to you, we will get it from them on your behalf.

The BEST Medical Care

We understand that you need treatment and help right from the start of the claim. That’s why we will find you a local private treatment provider do an assessment and provide you with whatever treatment is required as quickly as possible. We sort out the funding for it so you don’t pay anything up front – the fees are claimed back from the insurers at the end of the claim.

We will also organise an appointment with an expert to assess your injuries which will help us value the claim and find out what further treatment or investigation you need.

Your Losses

Keep any receipts or invoices for repairs for your bike or clothing / items damaged in the accident. If you need a new bike or need the money for repairs ASAP, we will seek an interim payment from the other side. This is a part payment before your claim is settled, and can be based on your losses and expenses such as repairs or replacement of a bicycle and equipment.

Maximising Your Claim

Armed with our expert medical evidence, when you’re ready to settle and your treatment is complete, we will fight tooth and nail for the highest payout we can get for you. Unlike many other law firms who are happy to accept standard amounts that fall within the legal brackets, we’re not afraid to get on the phone and pressure the insurers to pay out as much as possible. I’ve seen it done on our cases before – including mine and my partners. We’re happy to go the extra mile.

Give us a call on 0800 634 75 75 for advice about your claim today. If you’re happy with the way we work, we can get a claim set up and moving forward on the same day you instruct us!
