On 1st April 2013, the whole personal injury system was shaken to its core when the government decided that the innocent victims should not be allowed to recover all their legal fees for pursuing a claim from the opponent. Whilst lawyers can still recover most things, we are no longer allowed to recover a success fee, which helps us fund no win, no fee claims, or an After The Event insurance premium, which is insurance to protect the client against costs.
A cap has been placed on lawyers so we cannot charge anymore than 25% of a person’s claim for pain and suffering and past financial losses for the success fee, and most law firms are now charging the full 25%. On top of that, they are asking for payment of the insurance as it’s no longer recoverable from the opponent either. To try and help offset clients being charged, compensation victims do get an extra 10% compensation under the new rules – but they are still at a loss.
According to our research so far, the vast majority of law firms have settled on charging the full 25% and are asking for payment of the insurance. People are losing out. But our boss here at The Injury Lawyers decided to be different – as we have always tried to be!
That’s why for many types of accidents like work accidents, public liability accidents (in a shop, supermarket, bar, etc), claims against the highways authority, product claims, and some others, we are still offering you the opportunity to keep all 100% of your claim.
Most other law firms are calling us crazy; some allege that we are lying, or say there is a catch. But rest assured, if your claim falls within our criteria for 100%, you will receive the full 100% of your payout. You actually kinda get 110% because we won’t be taking the extra 10% you are allowed to get under the new rules.
So what’s the catch? How can we do this? Is it even possible?
Most law firms are telling people that “everyone is charging 25% now” which isn’t true at all – we’re not. Here is how we are able to allow you to still keep all 100% of your payout.
Success Fee – We waive it!
The unrecoverable success fee that is now being charged to a client at a rate of up to 25% is waived in our agreement. We cannot recover it from your opponent, but we are entitled to charge it to you. But luckily for you, we are happy to waive it! We are essentially not charging you a success fee.
After The Event Insurance premium – we pay for it!
We pay the premium for a £25,000 policy of insurance ourselves so you don’t have to. It’s as simple as that!
So why aren’t all other law firms doing this? Why are we the ones who dare to be different and offer you the opportunity to keep all 100% of your payout? Is our service any different? Are there other fees?
As a law firm, we pride ourselves on the service we provide, and we outline the service as part of our agreement – so you can rest assured that you are still in the best of hands. There are no upfront fees to pay or hidden deductions to pay instead – if you are awarded £5,000 for your compensation claim, you receive £5,000 – it’s as simple as that.
So how do we afford to do this?
We still do get paid for our work – we are still entitled to recover most of our legal fees from the opponent, it’s just we can’t recover as much as we used to be able to under the old rules. Basically we have decided to take the hit instead of letting our clients take the hit. We don’t like the idea of charging clients, and we will always avoid the need to where we can – so with certain types of claims we can still offer you a 100% agreement.
Over the years we have been practising, we have only ever represented victims of compensation claims. As such, we have a very efficient way of working, and we have never been involved in the referral fee system that has plagued the personal injury industry for years. Many law firms have been paying claims companies and insurers millions of pounds to buy cases from them. Referral fees were also banned on 1st April 2013 – but this hasn’t affected us as all our clients have always come to us directly, and we have never bought a case!
