Burnt by a Colleague at Work – Can I Claim?

burn injuries at workFirst things first – I’m discussing negligence here, not maliciousness. So if you are at work, perhaps in a kitchen, and a colleague spills something hot on you or walks in to you whilst carrying hot soup for example, can you make a claim for personal injury compensation?

Vicarious Liability

Vicarious liability means that the negligence of a colleague falls on to the employer. So if a colleague fails to adhere to procedures and policies in the workplace and causes a burn injury to you, you can claim from your employers insurance.

Some easy examples – restaurants should have separate in and out traffic for staff when it comes to carrying hot food and liquid from the kitchen to the front of house. If a colleague goes in the wrong way and you collide, you could make a claim. Equally if a colleague was rushing around and knocks in to you and causes a burn, you could also make a claim.

You’re Covered!

I’m talking covered by insurance here – this isn’t an attempt at a pun in the event you end up covered in something hot causing burn injuries. Your employer has an important duty to have a policy of Employers Liability Insurance which will cover you for claims in the workplace.
