A lot of people are keen to know how much compensation they may be entitled to after having an accident – and when it comes to whiplash accident victims, people are often very keen to know what the average whiplash settlement figures are.
So what is the average whiplash settlement for a personal injury compensation claim?
Firstly I need to let you know how the system works – as there is a lot to consider. The whole value of the claim is based on the following things:
- The length and severity of your suffering
- The extent it has had an impact on you – some people are affected more (for example more active people may be unable to enjoy exercise and as such have had a bigger impact than someone who perhaps doesn’t exercise)
- Your losses – like lost earnings from time off work, medication expenses, general medical and treatment expenses, and any other financial losses or expenses on your part
Whilst financial losses and expenses can be worked out with evidence and a calculator, how do you work out what you are entitled to just for the whiplash injury itself? The only way to properly value the injury side of things is to:
- Have a report compiled by a suitably qualified medical expert – not your GP; the experts we use are able to give us a medico-legal report
- Have a qualified personal injury lawyer value the case using their wealth of experience, the report, and official guidelines and law
So I can give you the average whiplash settlement statistics, but how much your claim is worth itself is based on all of the above.
WARNING!
If you’re dealing directly with an insurer, you’re not being smart – research has shown that people get up to four times more with a solicitor, and we’ve looked out our own cases and we often find we get a heck of a lot more compared to the first quick offers insurers will make at the start.
So, to give you some figures:
- On average a minor whiplash claim will settle for around £2,500.00 according to statistics
- The official bracket for minor injuries associated with whiplash symptoms is roughly between £1,000.00 – £5,000.00
But it all depends – because I got £6,500.00 for my whiplash claim, and call me bias or not, but a lot of that was down to the lawyer (i.e. my boss!) battling for the best payout possible.
