Also known as No Win, No Fee – this means that a solicitor should not charge you if a claim doesn’t win. This isn’t technically anything to do with 100% compensation as an agreement for funding should encompass both scenarios of winning and losing as separate things; but a No Win, No Fee agreement is the common name used for a Conditional Fee Agreement which outlines what you pay whether the claim wins or loses.
Does No Win, No Fee mean I pay nothing?
The idea is that you don’t pay anything if the claim doesn’t win. But it can depend entirely on what the terms of the agreement are with your solicitor. Ours is genuine in our opinion, meaning that we really don’t charge you anything if the claim loses and you have adhered to the terms of or agreement. But some solicitors may have terms or exclusions in there meaning you may still have to pay for certain things.
So it does depend – you should read any agreements carefully and make sure you speak to your solicitor and get clear answers when it comes to the question of what costs you might pay.
Can I get a No Win, No Fee?
It’s a commercial decision for a law firm to accept your claim on a No Win, No Fee basis. If we don’t win, we don’t get paid by the other side – so we have to consider the risks of accepting your claim on a No Win, No Fee basis, and decide if we’re prepared to take the risk of not getting paid if we don’t win.
We will normally do this by assessing whether we think the claim has a good enough chance of winning. If it does, we may offer a No Win, No Fee guarantee. If we didn’t think the claim could win, we may not offer it.
What Happens if I Win?
A No Win, No Fee really refers to what happens if the claim doesn’t win, so what happens if the claim does win could vary from solicitor to solicitor. For most claims we offer a 100% compensation agreements as well as a No Win, No Fee guarantee. Most solicitors don’t offer 100% compensation agreements anymore, so keep an eye out for that.
