100% Compensation from The Injury Lawyers
You may have heard that the government have stopped the Success Fee being recoverable from the other side. As of April 2013, the Success Fee is no longer recoverable from the other side which means that lawyers are now taking it from your compensation payout if you win.
So how much are you going to lose?
Now the Success Fee is no longer recoverable, the government have capped the deduction at 25% which means you can’t lose any more than 25% from your payout for the lawyers Success Fee. The Success Fee is important as it allows lawyers to take on cases on a No Win, No Fee basis – i.e. not charge people who claim and can’t win their case – because sometimes its too hard to know whether you have a valid claim unless you actually pursue it.
Most firms appear to have settled on 25% as a market rate, given that’s the most they can’t take. For some claims, we could claim much higher rates from the other side depending on the risk of the case in the past. Now, a lawyer can’t take any more than 25% from you now the Success Fee is no longer recoverable.
So can we give you 100% compensation?
Yes, we can. We agree for most claims to waive the Success Fee charge – so we don’t recover it from you, we just waive it.
So because we don’t charge you a Success Fee, you get to keep all 100% of your compensation payout.
How do we do this?
Simple – lawyers still get paid by the other side, we just don’t get as much as we used to now that the Success Fee is no longer recoverable. All we’re doing is receiving less fees for your claim by not charging the Success Fee to you and waiving it.
We can afford to do this because we take on and win a high volume of claims. Most other firms probably can’t afford to not charge you the Success Fee, whereas we can. We’re also very efficient at what we do as we only ever represent victims for compensation claims.
