100% compensation for work accident claims
The Workplace (Health, Safety and Welfare) Regulations 1992 places a duty on your employer to take all reasonable steps to prevent accidents from occurring in the workplace. The regulations actually have a specific section designated to the condition of floors and traffic routes that is designed to cover the issue of slips, trips, and falls in the workplace.
So if you trip over loose wires in the workplace, can you make a claim for personal injury compensation?
The Law
The regulations state:
(3) So far as is reasonably practicable, every floor in a workplace and the surface of every traffic route in a workplace shall be kept free from obstructions and from any article or substance which may cause a person to slip, trip or fall.
As such, loose wires should not be allowed to expose anyone in the workplace to a potential tripping hazard. Whether wires are strewn or stretched across walkways, under desks where feet can get caught, or dangling from overhead or from walls, you may have a potential claim.
Will I win my claim?
Winning the claim is all about what reasonable steps your employer should have taken to stop the accident from occurring. If they had full knowledge of the hazard and failed to act on it, they should be liable. If a colleague is responsible for being ignorant of health and safety legislation, your employer is liable for their negligent actions.
It’s fairly easy to prevent wires from being a hazard by ensuring they are not in walkways, and ensuring cable tidies or other means are used to secure potentially exposed wires. So there should really never be any situations where loose wires are allowed to become a hazard.
100% compensation and No Win, No Fee
Unlike most other firms who will take 25% from your claim if you win, you can keep all 100% of the compensation that is rightfully yours if you claim with The Injury Lawyers for a workplace accident claim. We also offer a full No Win, No Fee service as well, meaning you’re not charged if the claim is unsuccessful.
