100% compensation for workplace accident claims
Working in care homes can be dangerous, especially when you’re caring for people with little or no mobility at all. Essentially it becomes a manual handling issue, and the same rules and regulations can apply which an employer must adhere to in order to make sure their employees are not injured.
It can be so easy injuring yourself when trying to move a patient in awkward circumstances, and we take on a lot of claims against negligent care homes. So here’s some advice for you.
The Law
As I said, it’s a manual handling issue and therefore The Manual Handling Operations Regulations 1992 apply. This means an employer must:
- Provide equipment to remove the need for manual handling where possible.
- Adequately train and supervise staff for manual handling operations.
- Risk assess any tasks that may require manual handling.
The obvious equipment that is common in care homes would be things like lifts, hoists, wheelchairs, and moving beds. But even then there is still an element of manual handling when manoeuvring a patient in such equipment, or moving a patient on and off such equipment like a hoist for example. So the fact there is equipment doesn’t absolve the employer at all of their duties.
When it comes to training, constant and adequate training needs to be completed so employees are confident and comfortable in performing any manual handling tasks. Staff need to be fully aware of how to perform a task correctly and be fully up to speed on the nature of the dangers they can face through poor practise. Back injuries, which are the most common in these scenarios, can be serious and very debilitating.
So any tasks of this nature to be fully risk assessed so staff are able to perform a task with minimal risk to their health.
