For a council claim, the Highways Act applies; on private land, the Occupiers Liability Act applies; and if it’s in the workplace, The Workplace (Health, Safety and Welfare) Regulations 1992 apply. All generally place a duty on whoever is in control of the area to take reasonable steps.
Reasonable steps would normally be systems of inspection and maintenance. On private land or in the workplace, you’d expect this to be fairly common as people of authority like staff may be there all the time. On public land however, it’s down to systems of inspection based on how frequent the area is used. Inspection intervals can range from monthly to annually – so if they can prove a pothole has appeared in between inspection periods, they can defend the claim.
