The rules of the road are fairly clear when it comes to T-junctions. Normally the road is clearly marked to indicate who has the right of way – and where a driver must give way to you, its expected that they will do so.
But if a driver pulls out of a T-junction and hits you, or perhaps they pull out in front of you leaving you no time to stop and resulting in a collision, you may have a claim for personal injury compensation.

Will you win?
Most likely, yes. If the other driver pulled out of the T-junction and failed to give way to you, they should be fully 100% liable for the accident. What happens in a claim?
In a straightforward case like this, it should be nice and easy to get a claim set up and started right away for you. Normally all we need to do is submit a Claim Notification Form directly to the insurer of the driver at fault, and they then have a period 15 working days to accept liability. If the circumstances are nice and straightforward, they should accept in good time.
All that we then need to do is put a value on your claim. We do this by sending you to see what we call a medico-legal expert who will produce a report for us that we then use to value the claim. Their report should give us all the information we need to put a value on the case, which is normally determined using the report and based on the length and severity of any suffering endured.
On top of that, we can make a claim for losses, such as lost earnings from time off work, travel expenses to and from medical appointments, or perhaps private treatment costs. If you’re suffering from a typical case of whiplash, physiotherapy is normally the best way to recover and this is something we can look to fund on a private basis and then get the fees paid for at the end of the claim directly by the insurers, or as an additional losses claim on top of your payout.
Once we have all of our evidence collated, we will look to negotiate the best offer we can from the other side. So long as they accept liability early and you are not seriously injured or suffering for a long period of time, there’s no reason as to why we can’t get a claim settled in a few short months.
