Product liability is when a product you have purchased from a supplier is not safe to use or has not been made with the proper care and attention that it should have been – and as a result this has caused an injury to you as the consumer.
The law doesn’t just cover physical things though; any service you purchase also comes under the same regulations, such as purchasing a taxi ride or hiring a builder. These still should be supplied with proper care and attention. How do I know if the rules have been broken?
Without using too many words, the general rule for knowing if a company has breached the Supply of Goods and Services Act 1992 and can therefore be claimed against – is if the good and/or services provided to the consumer is defective or dangerous.
So if you believe the goods you have purchased, like a smartphone or a child’s toy, is defective and has caused an injury, you may have a claim. If a service you have received, be it building works or cosmetic surgery, hasn’t been provided with reasonable care and skill, you may also have a claim.
