The University Hospitals of North Midlands NHS Trust has set up a compensation fund for victims of skull surgeon Roger Bainton who used an experimental bone substitute and performed unnecessary treatment on patients, the BBC has confirmed.
Mr Bainton was suspended in 2013 and 88 cases were investigated with the General Medical Council finding at least 18 cases of people being harmed.
Bainton, a surgeon who performed facial rebuilds for accident and assault victims, abused the trust placed in him by reportedly using an unproven and experimental bone substitute called DBX to treat damaged eye sockets. Evidence also showed that he performed unnecessary procedures to treat jaw injuries.
As specialist medical negligence solicitors we can tell you that most cases are a question of whether a surgeon or doctor has failed to act appropriately through missing something or making a mistake. In the case of Mr Bainton, he has reportedly flouted his position of power by performing procedures that were both unnecessary and unapproved. This kind of negligence is astounding to hear of and we welcome the decision of compensation fund being founded.
We have represented victims where compensation funds and claims handling agreements have been established to keep the costs of litigation minimal and to avoid the use of court time. Setting up the fund is the right direction to make sure the victims who have been affected are able to access the compensation they deserve as efficiently and as quickly as possible.
