Have you got your got your foot caught in plastic wrapping? Those hard, plastic, white wrappings can be a real danger, and we take on a lot of claims both in the workplace and in public places like supermarkets and shops where people have been injured by them. You can land really hard on the floor and do yourself some real damage. If you’re reading this then I may already be preaching to the converted and you’ll know how bad it can be!
If this happens to you then you have the right to make a claim for personal injury compensation.
The law for both work incidents and public places are similar in many ways. There is always a duty on those in control of a premises to take all reasonable steps to prevent people from being injured by tripping hazards. So, winning the claim can be very circumstantial, and it’s probably better for me to discuss some examples.
For one, plastic wrapping is often caused as a result of staff unpacking goods. If it is left on the floor by a member of staff then their employer can be vicariously liable for a negligent person leaving the wrapping on the floor. In these kinds of circumstances you should have a good claim.
Sometimes tripping claims can come down to systems of inspection and maintenance in reviewing floors for hazards. What if it was a customer who dropped the wrapping? If so, that would not normally be the fault of the premises owner, and so the length of time the wrapping has been there for may be important. If no systems of inspection are in place then the wrapping could be there for a long time and posed a prolonged tripping hazard.
But in the vast majority of cases we find that it’s workers who have been the negligent ones which means that you should have a good claim. No matter if you have been lucky enough to escape with minor injuries – or where you have landed hard and badly injured yourself – The Injury Lawyers can help you.
