The cut was on the head and was on the parting of the hair which has left it visible. It could become way more visible with shorter or thinning hair, and unfortunately it’s permanent. Whilst many scars that are permanent do not leave any long term actual physical pain, it is the emotional and psychological impact that often needs to be assessed.

Liability disputed!
The insurers tried to dispute the claim saying that the equipment was reasonably inspected and that there had been no prior reports of problems or incidents. In law this can be a viable defence under The Occupiers Liability Act which is the legislation we use to claim with. Those in control of premises only have to take reasonable steps to prevent injuries, and you cannot normally just claim because something has happened. We must still prove that the injured person has been the victim of negligence.
They provided inspection records and a lot of documentation in support of their denial of liability. At this point, many lawyers may not have went any further with the case.
