Supermarket roll cage injury – your rights explained!

We’ve helped a lot of people claim for work accident compensation after they’ve been injured by a supermarket roll cage. There are a lot of ways in which supermarket roll cages can cause injury to you, and your rights are enshrined in law when it comes to being eligible to claim.

We, as expert injury lawyers, are here to explain those rights to you and here to fight for your claim when you need us. As a firm of specialist work injury lawyers your claim is in very safe hands with us.

How you can claim for a supermarket roll cage injury

Supermarket roll cages are commonly classed as work equipment, which is governed by The Provision and Use of Work Equipment Regulations. The law here puts a very important duty on your employer to ensure that:

  • Supermarket roll cages are not defective
  • Supermarket roll cages are suitable for use
  • You are trained and capable in the use of supermarket roll cages to an effective standard

The law is quite tight on the employer, and it is designed to be this way to make sure employees are not injured in easily avoidable circumstances. If you are using a supermarket roll cage which breaks or is already broken and this causes an injury, you can claim compensation. If the roll cage was not suitable for the task you were undertaking, you can also claim.

Training is, of course, vital. If you have not been properly trained and you end up injuring yourself when using supermarket roll cages because of the lack of training, you may also claim.

Wait, there is more…

What if the supermarket roll cage itself hasn’t directly caused the injury? What if it was too heavy and you were injured trying to move it, or what if it fell because it was top heavy? What if you had to move it over land which was unstable or dangerous? What then?

Well there are plenty more rules to choose from! Take The Manual Handling Operations Regulations which govern manual handling. Supermarket roll cages which are too weighty or too large to move and cause an injury may be in direct breach of these regulations, meaning you can claim.

Floor too dangerous? We have The Workplace (Health, Safety and Welfare) Regulations which puts a duty on your employer to ensure that all traffic routes are safe to use.

So can I claim?

Well if the accident was not your fault you may have a valid claim for personal injury compensation. If you have been injured when using a supermarket roll cage in circumstances relatable to the above, or where you feel you could claim, get in touch.
