The Care Quality Commission published a report this year on a care home in Derbyshire where it was found that the care home residents had suffered neglect in the form of not being fed properly; being locked in the home; and not receiving medication.

Gresley House Residential care home in Derbyshire was deemed inadequate and required improvements based on the report findings of the Care Quality Commission (CQC). The report found that resident’s health and wellbeing were at risk, with one person sustaining an injury from a fall that happened sometime during the night.

Appallingly, the resident was not found till 7am the next morning.

Investigations found that there was no proper routine systems in place for assessing the health and care of the residents. When concerns were raised by the manager about safeguarding residents at night, the service provider allegedly failed to act. Not only did the report raise safeguarding concerns, but also concerns about resident’s dignity not being upheld.

Reportedly, there was inadequate training for some of the staff members as they did not have the skills to be able to help some residents, as well as a lack of staffing in general – especially at night. Concerns were raised to the service provider, but these were apparently ignored.

The care home premises carried risk that were not properly maintained, and therefore residents suffered injury and were unable to use the space effectively.

Ultimately, the report found that the care home had breached the Health and Social Care Act 2008 and the (Regulated Activities) Regulation Act 2014. The Care Home Commission report has outlined the regulations that were not being followed and the enforcement action the Commission will be taking against Gresley House Residential care home.

What was the outcome?

The report that was carried out provided what actions the care home should take in order to rectify the issues raised, as well as identifying the regulations that the care home had not met. Due to the regulations not being met, the CQC took enforcement action against Gresley House Residential care home.

The enforcement action that the CQC decided to take was a warning notice for the two breaches of Health and Social Care Act 2008 and the (Regulated Activities) Regulation Act 2014. The health and safety of residents was not adequately assessed, and risks were not properly reduced, according to reports. On top of that, the process in place did not adequately assess, monitor, or improve the quality of services provided.

The provider was told to take action, but apparently failed to do so, in terms of dignity and respect, need for consent, safe care and treatment, and staffing.

Staff also failed to assess patient capacity in line with the Mental Capacity Act 2005.
