Victims of the recent Spire Hospital recall affecting, so far, 217 patients of Mr Habib Rahman could be entitled to make a claim for personal injury compensation on a No Win, No Fee basis.
The recall has been initiated over fears that some patients may have been subjected to unnecessary surgical procedures. It may be that patients can claim for any suffering and loss they have endured, and they could also claim for any lasting damage or complications that may have arisen from Rahman’s actions.
You can read more about the recall and find out if you can claim today on our dedicated advice page here.
Basis of a claim for patients of Habib Rahman
The basis of medical negligence claims for former patients of Habib Rahman at Solihull’s Spire Hospital could come down to unnecessary treatment.
If it’s the case that you have received treatment – which could be from an operation – and it transpires that you didn’t need that treatment, or that the treatment wasn’t appropriate, you may have a case. You will have likely suffered pain and loss of amenity during the surgery and recovery period, and that’s an element you can claim for.
It’s also common for surgeons to try and avoid surgery where possible; especially shoulder surgery which is understood to be the focus of the recall. It can do more harm than good, and the complications that patients can suffer from can be significant. If you are left with complications and problems that have arisen from negligent and / or unnecessary surgery, you may also be able to claim for this.
What can you claim for?
If you were a patient of Mr Habib Rahman and it has been confirmed that you have been the victim of negligent and / or unnecessary treatment, there are a few things that we can look at.
As with most legal cases, you can claim General Damages and Special Damages.
General Damages is for any pain, suffering and loss of amenity caused which we can value using an expert medical report. This will look at past and future suffering and will also be used to justify the second element, known as Special Damages. Special Damages accounts for any losses and expense which could be made up of lost earnings from time off work, medical expenses, private treatment costs, and more.
If you can no longer work as you did before, and this is because of negligent surgery, this can also be considered. It may be that you have a future lost earnings claim that could be substantial.
