A UK review of cosmetic procedures has labelled dermal fillers a “cosmetic crisis waiting to happen” according to sources from the BBC. They are regulated at the same level as toothbrushes and there are considerable fears that dermal filler procedures could cause lasting damage to patients.
With the PIP scandal still fresh in our minds as thousands of women are still battling clinics and credit providers for compensation after being fitted with poor standard implants filled with industrial grade silicon, we’re all aware that the whole cosmetic surgery industry is poorly regulated.
It seems that the companies administering these treatments are putting profits over patients, with procedures like dermal fillers and Botox readily available on the high street and as simple to access as nipping to your hairdressers for highlights. Reviews have indicated that there are no checks on surgeons and ‘buy one get one free’ kinds of special offers are rife on the high street.
So given that the industry appears to be so unregulated to a dangerous level, we’re not surprised that people are having problems and looking to make claims for compensation when dermal fillers go wrong. There is a case that is also quoted on the report about a patient going blind immediately after having the procedure done! Other potential risks that could lead to a compensation claim:
- Incorrect Placement of the filler: which can cause lumps or bumps under the skin.
- Overcorrection: which may lead to some of the filler then needing to be removed (which is not always easy).
- Allergic Reactions: which you should be warned about. A discussion should take place before this procedure to ascertain any allergies you are aware of and the risks of an allergic reaction occurring. If you are not warned, you may have a claim.
These are just three examples of potential problems that can occur when having a dermal filler procedure. Whether you have a claim commonly comes down to one of two things:
Procedural Mistake
If the administer of the treatment has made a mistake, you should be entitled to claim for compensation for any adverse reaction. Given that you could end up with scars or lumps or other irregularities on your face, the claim would cover the pain and suffering as well as the look of any defects on the face. Given that the face is such a prominent area, defects are clearly hard to live with.
Failure to Advise
If you are not advised of potential side effects or made aware of the problems that could occur, you may also have a claim. You should be allowed to make an informed decision where you are made comprehensively aware of what the procedure entails, and what could go wrong.
