Road Traffic Accidents: Children

When considering making a claim it is often confusing when deciding who was at fault, especially in cases involving children. As a motorist you owe a duty of care to pedestrians, as they are extremely vunerable to road users. Pedestrians also owe a duty of care to motorists. It is there duty to show consideration and care to other motorists when crossing the road.

However some pedestrians require additional care, this may be due to disability, infirmity or age. The most obvious pedestrian that needs extra care and consideration is a child. Now that the new school year has begun, there will be more children on the roads during rush hour, both morning and evening.

Children, especially those aged under ten years of age don’t have a full understanding of danger. Therefore they won’t necessary think to look once, never mind twice before crossing a road, or stop to think before running out from behind a parked vehicle.

Road Traffic Accidents: Vehicle Lighting

When we all first began learning to drive I’m assuming it’s fair to say that we found it difficult remembering everything we had to do before actually driving off.

We’d get in the car, adjust our seat, adjust our rear-view and wing-mirrors and make sure the car was in neutral. We’d then put on our seatbelt, check both mirrors and our blind spot before hitting the road.

The best thing about it was that if we did forget something, we’d have our good old driving instructor sat at the side of us waiting to tell us what we’d done wrong. A habit of mine was forgetting to check my wing-mirrors, or to actually put the car in gear.

Second Dog Attack in a Week

Dog attack claims are becoming more and more common in the UK. Therefore it’s no surprise that we all fear for the safety of ourselves and our children if we come into contact with them.

This comes after the BBC revealed another report of a 10 year old girl who has been bitten in the face by a Japanese Akita dog. Toni Clannachan, of Kilmarnock, was attacked by the dog as she was playing in a school friend’s garden, at a house on Tuesday.

Her father, James Dixon, told the Daily Record newspaper: “These dogs shouldn’t be with families or around kids. They are killing machines.”

Dark Night Road Dangers

Is it just me or have you noticed the dark nights creeping in? The last time I looked it wasn’t getting dark until 10pm at the earliest. However in the past week or so it’s started getting darker around 8.30pm. This can only mean one thing… Winter is just around the corner. Not only does this mean we’re going to have to dig out last season’s sweats to keep us warm on those cold winter mornings, it also means that we’re going to have to take extra care on the roads.

A lot of drivers, my mum been one of them, don’t feel as comfy when using the roads in the dark. This means that when it starts getting dark at 4pm drivers maybe more unsteady than normal.

It’s the hint of fear like not been able to see what’s coming towards you that worry’s some drivers. I personally find it more difficult to judge the distance between myself and other cars when it’s darker.

Can You Claim For A Taxi Accident?

Are you in a position to claim for a taxi accident? Well that can depend on a few simple factors:

  • Did you contribute to the accident; if the answer to this is no, then potentially you may have a claim as the accident was not your fault and so why should you suffer at the expense of someone else’s actions?
  • Where you in another vehicle; if you were in your own car and were involved in the accident and the taxi driver was at fault then you can make a claim for compensation against the taxi driver, your compensation will come from the insurance cover.
  • Where you a passenger in the vehicle? You may worry that you can’t claim if you were a passenger but actually you will have quite a strong claim for compensation because usually as a passenger you do not contribute in any way to the cause of an accident. In the eyes of the law, passengers are often seen as innocent parties. Any compensation that is awarded to you will be claimed from the taxi driver’s insurance company.

Country Roads Putting Your Life at Risk

Have you ever questioned the reason why winding country roads welcome the national speed limit?

It’s as though they’re creating a play ground for young drivers, an open invitation to come along and test out their brand new ‘speed machines’.

What they don’t realise is that what often comes along with the national speed limit, especially on quiet country lanes, is a car full of teenagers looking for fun. However, this often ends in tragedy as some drivers misjudge the road.

No News is Bad News?

Have you ever been to hospital or your GP for tests and told “no news is good news”? The idea being that, if there is something wrong with the result, you will be informed and the correct action is taken. This is something we take for granted;  but should we?

A 3 year old girl, Miss R, was taken to A+E by her worried parents. She was examined and kept in overnight as it was noted that she had a high temperature. One of the junior doctors also sent a urine sample to check for infection. The next day, as the patient was much better she was discharged by the Consultant, with the diagnosis being “Likely Viral Illness”.

Unfortunately, the microbiology department had found that there was, in fact, a urinary infection. These results were phoned through to A+E, but never passed onto the Consultant. A day later a formal report arrived, and was signed by a junior doctor, but not acted on.
