The Costs of Claiming for Compensation

It’s probably the most asked question we at The Injury Lawyers hear when we take on a new case – and it’s perfectly understandable for people to be asking it. So, here’s a quick insight in to the costs of claiming; you may be pleasantly surprised at the answer…

No Win No Fee

Ever heard of this term before? It’s quite a common one we injury lawyers talk about! Most No Win No Fee agreements such as ours (I say most, because not all law firms out there work the same us) do exactly what they say on the tin! If the claim is lost, the claimant is not charged for the solicitors work. So who pays us? The answer is – no one!

Motorcycle Accidents

Anyone in to motorbikes? Or anyone in to music at all? If you are, then this article may be of interest to you. According to sources from The Guardian, songwriter and producer Daniel Lanois has been injured in a motorcycle accident, and is reportedly in intensive care in Los Angeles (source).

Lanois is well known for his works with UK rock legends U2, as well as having worked alongside the likes of Bob Dylan and Neil Young. The accident earlier this month has been described as serious, with several of upcoming tour dates cancelled due to the severity of his injuries.

Road traffic accidents are common enough; but accidents involving motorcycles often easily occur -and the injuries sustained by the rider are usually always quite severe. We drivers know well enough the importance of checking roads we are merging on to (look, look, and then look again; and again for good measure!), checking our blind spots when switching lanes or overtaking, and looking out in general for motorcyclists on the road. They are harder to spot – so we must take extra care in looking out for them. We have all surely seen the Think Bike adverts on the TV – for me, they really hit home!

Lung Transplant Gone Wrong

A lady has died after receiving a lung transplant from a 30 year old smoker.  The lady was a cystic fibrosis sufferer and was 28 years old when she underwent a double lung transplant in January last year, but sadly died from pneumonia in the following July. The family were not told that the donor was a smoker. It states that the lady underwent the transplant to prolong her life expectancy as her condition deteriorated, according to the news report. (source)

If you or your family have been subject to any sort treatment from the NHS that you feel has been inadequate or negligent, or it hasn’t been explained in a clear, precise manner and you or your family has been harmed as a result, you may have a potential claim for compensation.

First of all, it would be best if you place a complaint with the NHS directly; they will make investigations into the matter. Also, try to record exactly what happened in your own words – how do you believe things went wrong? Why were you mistreated? Any evidence that you can collect will be very useful when it comes to placing a claim i.e. photographs, witness statements, dates, and times.

Claiming for Compensation and the World of Personal Injury

I think the majority of people out there have a basic understanding of what personal injury is about. But I think it’s safe to say that the vast majority of people who have never made a claim perhaps share a miss-guided view of what personal injury means.

I read a lot of stories and hear a lot of people discussing their grievances against claims for personal injury in public. The old stereotypes of people tripping over curbs, falling off ladders, or slipping on a wet floor and getting thousands of pounds, and the solicitors pocketing tens of thousands of pounds in legal fees, I often hear about. But is this a fair view of personal injury claims? Well, here are a few things to consider:

Minors Subject To Violent Acts Of Crime

Figures released by the BBC show that children are the subject of many violent acts of crime. Not only is it disgusting that violent acts are committed on adults it’s even more horrendous to hear of children who have been subject to these types of crimes, as the child has no way of defending themselves.

Figures show that almost half of sexual abuse victims are children; out of the 19,250 recorded incidents in 2008/9, 47% of these incidents involved the child as the victim. 30% of robbery victims were minors, and also 111,000 violent crimes were committed against under 18’s. It is also very sad to think, that out of these figures, these are only the cases which have been reported, as often the child feels too frightened to come forward. http://news.bbc.co.uk/1/hi/uk/10254922.stm

In these circumstances it can be a very difficult and upsetting time. No matter what you do, the awful memories of these incidents can never be erased. It is possible to make a claim for compensation in these types of situations. Again it will probably not make things better but at least the person living through these horrible times may gain some peace of mind in knowing that they can claim for some financial stability. These types of claims are dealt with by a government body known as the Criminal Injuries Compensation Authority (or CICA).

Grandmother Killed & Grandchildren Left Fighting for Lives

I’ve said it before, and I shall say it again; road traffic accidents are a common occurrence – they do happen all of the time. It’s always a tragedy to hear of a severe car crash resulting in life altering or even fatal injuries, but it’s even harder to hear when a crash is caused by the absolute selfishness of a drink driver.

There’s a very good reason why there is a drink drive limit – alcohol affects our brain and impairs our judgement and cognitive ability; both vital requirements to have working properly when driving. And we all know that breaching the safe alcohol limit is against the law for the very good reason that its puts the driver and other people on the roads in serious danger.

So why do people still do it!? And what are the tragic consequences…

Ever Heard Of Third Party Capture?

Third Party Capture is probably something that not many people have heard of. It’s something that a lot of insurance companies have in place to try and save themselves money. If you have been involved in a road traffic accident, you will probably receive a lot of phone calls from numerous companies trying to persuade you to allow them to deal with your claim – even from the third party’s insurance company.

The third party’s insurance company will try to make it sound very appealing for you to place a claim with them directly. For example, they will promise to settle your claim very quickly, which means less hassle for you. They will probably also tell you that you could receive your settlement figure in a matter of weeks. This will probably all sound very nice until you realise what they are actually doing – The Third Party’s insurance company will offer you all these things is an attempt to cut their fees. If you choose to go with them it means that they don’t have to pay any legal fees to a company dealing with your claim – and it also means they will more than likely under settle your claim!

Legal Expense Insurance – Watch Out!!!

You may or may not have heard of Legal Expense Insurance; your insurance company may offer it as part of your insurance cover on your car. But whatever you do, don’t pay for it!

Basically it is a service that insurance companies offer that is nothing more than a sham! What happens is, if you have had an accident and you report it through to your insurance company, they will most probably try to persuade you to place a claim with them for any personal injuries you may have sustained. I would strongly advise that you don’t place a claim for personal injury with them; this is because you will straight away lose money. Claims companies and Insurance companies are not equipped to deal with personal injury claims; it’s solicitors who can only deal with these claims efficiently.

Road Traffic Accidents involving Children

Many accidents occur each year on Britain’s roads, and it’s particularly upsetting when children are involved. The injuries can range from minor cuts and grazes to even fatalities. The majority of the time the child involved has, in no way, contributed to the accident; this means in the eyes of the law the child is considered an innocent party.

If you feel you want some form of justice or peace of mind for your child, you may wish to consider pursuing a claim for compensation. Although no financial sum will ever replace the loss or hurt you or your child may have experienced, it can provide some financial stability and compensation for the suffering endured.

Taxi Accident Compensation Claims

Lots of people use taxis everyday – from the elderly out on shopping trips to young adults enjoying a night out. There are many accidents each year involving taxis and their passengers. It may not be apparent to many people, but if you have been involved in an accident in a taxi, it’s likely you have a claim for compensation. Just because you aren’t a relation or friend to the person driving doesn’t mean you cannot pursue a claim.

In the majority of Road Traffic Accidents, passengers involved could not have contributed in any way to the incident, which usually means claiming for compensation is very simple.  In a lot of accidents involving taxis there are one or more passengers involved; again all passengers have a potential claim for compensation even if the taxi driver was at fault.
