Understanding how whiplash valuations are made

Here at The Injury Lawyers we deal with whiplash injuries on a daily basis. In fact, we would describe ourselves as whiplash injury experts because we have dealt with hundreds of claims for compensation for whiplash injuries. We are therefore well aware that, although many people do encounter whiplash symptoms, the suffering that follows differs from person to person.

No one whiplash injury is the same as the next; although it may be very similar. These whiplash injuries generally tend to arise from road traffic accidents, but could equally occur from playing sport; for example rugby.

Understanding seat belt safety in a car crash claim

We all know that we have to wear seat belts when travelling on the roads where they are provided. We know that we have to wear a seat belt in order to protect us and others in the car or vehicle if we were to have a road traffic accident; we also know that wearing a seat belt is a legal requirement for most people.

You may not realise however that there is another reason why you should wear a seat belt…

Compensation after a road traffic accident

The Watford Observer has reported that a Mr Mark Seabrook has obtained £5 million in compensation in the High Court last week. It came after Mr Seabrook was left paralysed back in 2006 when his motor vehicle was hit by a negligent thirty driver in Watford. In fact, the full list of injuries included numerous fractures to his ribs, a broken leg, as well as spinal, chest, lung and head traumas.  To make the matter even worse, the negligent driver had stolen the car that hit Mr Seabrook’s vehicle.

Not only has Mr Seabrook now been compensated for his devastating injuries, but Salliaman Khan, the negligent thief, has also been jailed for eight months.

In awarding Mr Seabrook this huge amount of compensation, account was taken of that fact that Mr Seabrook’s life had been ruined by the paralysis – that his job opportunities were now limited, and that he had in fact lost his job, and that he would need care and assistance for the rest of his life having now been confined to a wheel chair.

Whiplash symptoms, payouts and claim process

Whiplash can be a funny old injury – and I don’t mean “ha ha” funny, I mean strange and unpredictable funny, with many sufferers going through all sorts of weird and wonderful side effects and symptoms.

Whiplash really does affect different people in different ways. Yes – if you are involved in a high speed collision with a high velocity impact, it’s likely you will suffer more than if you were involved in a low speed, low velocity impact. But that being said, two different people in the same accident can end up with entirely different levels of whiplash severity and symptoms.

Getting you back on the road when you make a motorbike accident claim

There is much awareness around the safety of motorbike users on the road. I myself can think of many advertisements on television regarding motorbike safety as well as signs by the side of the road stating – ‘Think Bike!‘. This all serves to remind us of the vulnerability motorbikes have on the roads and to always leave them space and properly check the way is clear before proceeding.

Bikes are more difficult to notice than cars due to their size and speed; which increases their risk of being involved in a road traffic accident.

When an accident occurs, it may mean for the biker that their motorbike is damaged and unusable, and if they’re badly injured they’ll be unable to ride any bike for a long time. Ultimately, for the injured rider, it’s not only losing a way of getting about, but also a much loved pursuit.

Motorcycle Accident Claims Specialists

Road accidents are common enough – luckily, when we’re contained within a large chunk of metal surrounded by advanced crumple points and air bags, most car accident victims can escape with minor injuries at low speeds – unless of course you are a pedestrian or the impact was at high speed on a motorway. But – what about motorcyclists?

It’s no secret that accidents involving motorcycles can end up in absolute tragedy. There is plenty of government advertising instructing drivers to Think Bike!, and look, look, and look again when coming out of junctions, changing lanes, or turning in to side roads. Motorcycles are far harder to spot on the roads, particularly at night. Every driver should be continuously vigilant for motorcyclists at all times. If you spot one, you should keep them in mind all the time.

Unfortunately, it’s been common knowledge for years that you are far more likely to be involved in an accident as a motorcyclist – in fact, previous statistics have accounted for seven times more likely. So the general lessons to be learnt are for drivers to ensure to be far more aware of motorcyclists, and for motorcyclists to take extra care on the roads.

The importance of the Highway Code in road traffic accident claims

The Highway Code was created to give all road users, whether they are pedestrians or drivers, a full understanding of their responsibility when using the road. It was created to help keep accidents to a minimum and make sure drivers and pedestrians know what to do when using the road.

When courts are reviewing compensation claims, or deciding who is liable for an accident, they often refer to the Highway Code when justifying their decision to those involved. Throughout the years it has grown to be a part of road traffic accidents in English law.

Useful tips for preventing motorbike accidents

Motorcycle accidents often have massive impacts for those involved. Without the added protection a car offers, motorcyclists are vulnerable to serious injuries if they are hit or knocked off of their bike by another vehicle.

There have been numerous campaigns over the years trying to inform car, van and truck drivers to be even more careful and look out for motorbikes on the roads.

We decided to help the cause and print a few useful tips for drivers out there to take on-board and make sure you stay safe on the roads and don’t end up in an accident with a motorbike.
