3 Months off Work with Whiplash

With a whiplash injury, you can often be left with limited movement which means that a lot of the time you have to have time off work. This is usually a few weeks until the acute stage of your injury has settled down.

However, for some, the whiplash injury can be more serious and result in a long time off work. Whiplash injuries vary from mild, to moderate, and severe; and they can affect people in very different ways.

Most whiplash sufferers are able to manage to go to work after a couple of weeks though the use of painkillers, heat rubs and heat pads etc but some are left debilitated and will need therapy, injections and sometimes even surgery in order to help them on their way to recovery. Therefore a longer period of time away from work is necessary.

Do you Accept Second Offer for Whiplash Claim?

The amount of times I have received calls from clients saying “I don’t want to accept the first or second offer, I have been told to always accept the third” is ridiculous and quite honestly I am boggled as to where this “pearl of wisdom” has come from – because quite frankly it is utter rubbish!

Your whiplash claim will be valued based on medical evidence. An independent medical expert will be instructed in order to review you and provide a report and opinion on how long you are likely to be suffering with your injuries. This is the main aspect of valuing your injury.

The value of your injury will be placed in a bracket. For example: £1500 – £1750. This means that your claim is worth £1500 at the minimum and £1750 aat the maximum, according to the brackets.

How Much Would a Personal Injury Lawyer get you for Whiplash?

Whiplash injuries can range from the very minor to the severe and debilitating. Therefore, it is important that you seek the help of a expert personal injury solicitor to ensure that the compensation you receive is the right amount.

Compensation is awarded based on the severity of your injury and how long this will affect your everyday life, so it is important that the right amount is awarded – if you settle and then are still suffering you may statutory barred from bringing another claim (for the same accident) or trying to reopen or continue the original claim.

As well as personal injury solicitors, there are a number of claims management companies that will try and get you to instruct them. Similarly, your insurance company will also try to refer you to a solicitor and finally, there is also the possibility that the third party will try and capture you. All of the above may also say that they can get you the optimum amount of compensation but there may be more to this than first meets the eye.

In any personal injury claim, the amount of compensation you will receive is not a figure just plucked out of the air; the figures are based on your representative’s expertise and experience but also from the Judicial Studies Board Guidelines.

This is a set of guidelines which are used in order to help your legal representative to assess your claim and the value of it.

The assessment of compensation for your injuries will consider the following:

If I make a whiplash claim, do I need to go to Physio?

A whiplash injury is caused when you experience a sudden jolt or movement in your neck and it causes the soft tissue in the neck to be stretched and strained. Although whiplash does normally just affect the neck area, it can also cause great pain and discomfort in the shoulders and back.

Physiotherapy treatment is the most common rehabilitation treatment for this type of injury and is usually recommended by your GP if your symptoms are persistent as taking painkillers long term is not an effective way of treating a whiplash injury. However, in many cases, a course of painkillers will be sufficient for minor whiplash injuries and will see the client through until they have recovered. Therefore not all clients will need a course of physiotherapy.

Whiplash Claim Payouts

When clients approach us about making a whiplash claim, the most common question asked is usually “How much am I likely to get?” However, if you are still suffering with your injury it is very difficult to calculate how much you would be entitled to receive without obtaining accurate medical evidence.

Therefore, here at The Injury Lawyers, we obtain medical evidence on all cases so that we can accurately determine the amount of compensation you are entitled to.

You will attend an examination with a medical expert and they will provide us with a report which details your injuries and the time you are likely to be suffering for. This is called the prognosis and is what your injury claim will be valued on.

Compensation for a neck injury aggravated by a car accident

Neck injuries caused by a car accident can be quite severe – but can you make a claim for compensation when you already had a neck injury which the accident has made worse? Well the answer is yes. To be honest, the number of clients we already have which are suffering from some sort of pre-existing injury or condition is significantly high.

The key to a successful compensation claim when a previous neck injury has been aggravated by an accident which wasn’t your fault is medical evidence. Here at The Injury Lawyers, we would arrange for you to be examined by an independent medical expert, the type of expert will depend on the type of injury and also the type of pre-existing injury or condition you are suffering from.

Whiplash Payouts and Which Companies to Use

There are undoubtedly A LOT of personal injury solicitors out there that help with road traffic accidents and whiplash injuries. However, it is important that you choose the right one to help run your claim since, unfortunately, there are some out there that may present themselves as something they are not.

Whiplash is the injury primarily to the neck and is most commonly caused by the action of being jolted forwards and backwards quickly. This distorts the muscles in your neck and can consequently lead to long term problems in this area such as reduced movement and constant pain and discomfort. Settlements for whiplash injuries can differ with regards to the “grade” of the injury you have sustained. The JSB guidelines (for more information on these see the JSB guidelines blog) separate whiplash injuries into three main categories: minor, moderate and severe- with understandably the last being valued at the highest amount.

I mention these different categories as this links directly to being prudent when deciding on a solicitor to pursue your claim as it is important you are classed as the right one and receiving the right settlement.

Whiplash can occur in slips and trips but is mainly an injury which results from a road traffic accident.

Some whiplash injuries are quite minor and resolve in a matter of weeks – however client’s with moderate whiplash symptoms can be suffering for a lot longer than this. A lot of people see whiplash as a minor injury but whiplash can be severely debilitating.

Client’s with moderate whiplash symptoms are significantly restricted in their movement and experience constant pain and stiffness for quite some time.
